Liability Waiver

Assumption of Risk

I acknowledge that equestrian activities, including but not limited to riding, handling horses, and being in the vicinity of horses, carry inherent risks of injury, including serious injury or death. These risks include:

• Unpredictable behaviour of horses
• Falls from horses
• Contact with fences, jumps, and course infrastructure
• Environmental hazards including uneven terrain and weather conditions

I voluntarily assume all risks associated with participation in equestrian activities at TEC.

Release of Liability

To the maximum extent permitted by law, I release Tonimbuk Horse Trials Inc, its committee members, employees, volunteers, agents, and the property owner from any and all claims, demands, and causes of action arising from my participation in equestrian activities at TEC, including claims arising from the negligence of the released parties.

Safety Requirements

I agree to:

• Wear an approved safety helmet (AS/NZS 3838 or equivalent) at all times while mounted
• Wear an approved body protector when riding cross country
• Follow all instructions from TEC officials and staff
• Comply with Equestrian Australia (EA) rules and regulations
• Report any incidents or hazards to TEC staff immediately

Medical Authorisation

In the event of an emergency where I am unable to provide consent, I authorise TEC personnel to arrange emergency medical treatment on my behalf.

Indemnity

I agree to indemnify and hold harmless Tonimbuk Horse Trials Inc and its committee members from any claims made by third parties arising from my actions or the actions of my horse while at TEC.

Acknowledgement

By attending or participating in any activity at Tonimbuk Equestrian Centre, I acknowledge that I have read, understood, and agree to the terms of this waiver.

This waiver applies to each visit to Tonimbuk Equestrian Centre.
